California has decided to go ahead with its own plan to permit online poker rooms within its state borders. This comes at a time when the federal government is still facing legislative and judicial challenges to the UIGEA. Ex-Assemblyman Lloyd Levine is the one to lead this. His time in the Assembly was ended due to term limits and the state has constructed a bill that permits online poker without actually violating federal law.
The measure, if passed, will be called the California Online Poker Law Enforcement Compliance and Consumer Protection Act and will allow state residents to play at the online poker rooms licensed by their state. Check are being made by the state Gambling Commission and the state Department of Justice to make sure the framework does not breach federal statutes and that it contains necessary regulations for safeguarding the public.
A clause in the UIGEA specifically states that intrastate wagering is not illegal with Internet gambling and to allow its online poker network. California intends to use this to their advantage. Several gambling observers are troubled that the UIGEA will result in inadvertent payment blocks, as has happened in the New Hampshire and North Dakota lotteries.
The State of California currently maintains and enforces substantial regulatory and law enforcement efforts to protect thousands of Californians who play poker for money live in licensed California card rooms. It also provides no licensing requirements, regulatory structure or law enforcement tools to protect millions of Californians who play exactly the same games daily for money online. This is the statement cited in the bill in the need for regulation of online gambling.
The players and the operators need to be within state jurisdiction. The set-up for land-based poker rooms will be taxed and the games will be limited to those allowed on land. An amount limit, not yet specified will be imposed on the players’ accounts. This would prevent clients from losing less than a certain amount in any twenty-four hour period.
President of the Poker Voters of America, Jim Tabilio stated, “We have said that the goal of Poker Voters of America was creation of a regulated online intrastate system that conforms to Federal law and protects California players by licensing legal, secure and regulated alternatives to offshore online poker, [The bill] confirms that we’re on track to accomplish that goal.”
